Official Rules

THIS IS A TWO-TIERED SWEEPSTAKES, OFFERING ONE (1) GRAND PRIZE AND FOUR (4) FIRST PRIZES. THE GRAND PRIZE WINNER WILL BE SELECTED FROM ALL ELIGIBLE ENTRANTS WHO COMPLETE AN ONLINE SURVEY. FIRST PRIZE WINNERS WILL BE SELECTED QUARTERLY FROM AMONG ELIGIBLE GRAND PRIZE ENTRANTS WHO ADDITIONALLY REQUEST: (A) A TEST DRIVE APPOINTMENT, (B) A PRICE QUOTE, (C) ADDITIONAL INFORMATION OR A SERVICE APPOINTMENT, (D) COMPLETE AN ONLINE LOAN APPLICATION ,AND/OR (E) THOSE INVITED BY SPONSOR TO COMPLETE AN ONLINE “CUSTOMER FEEDBACK SURVEY”.

How to Enter: To be eligible for the Grand Prize: 1) Complete the entry contact information form provided or, where applicable, enter your promotional code as it appears on the communication you received (mailer, flier, email, etc.), and 2) Complete the survey in its entirety. A valid survey entry requires a valid name, zip code, telephone number, and email address. To be eligible to win a First Prize, complete the above steps, and, when prompted, select from one of the optional services displayed.

Eligibility: To enter this sweepstakes you must be a legal US resident, residing in one of the 50 States or the District of Colombia, and 21 years of age or older. Employees of The Intellimark Group (the “Sponsor”), their agents/dealers, their respective advertising and promotion agencies, affiliates, subsidiaries (collectively, the “Sweepstakes Entities”), and any individual or company directly associated with this sweepstakes, and the immediate families of these entities (parents, children, siblings, spouse), as well as members of the respective households of these entities (whether related or not) are not eligible to participate.

First Prize Drawings: First Prize winners will be randomly selected in a quarterly drawing to be held on or about 04/30/08, 07/31/08, 10/31/08, and 01/31/09. First Prize entrants not selected as a winner in the drawing will not be rolled over into the next quarterly drawing.

First Prizes and Conditions: There are four (4) First Prizes and winners will receive a Marketing Promotions Certificate good for a 5 day cruise for two (2) people on Carnival Cruise Lines. Prize includes an ocean view stateroom on any Carnival Cruise Lines Ship of winner’s choice (based on availability), taxes, port charges, and standard shipboard gratuities with an Approximate Retail Value (ARV) of $1,575. Winner will be given the opportunity to select from available cruise dates and destinations as listed on the certificate. No other specials, coupons, or free upgrades will apply. All expenses and costs not expressly listed above including, but not limited to, transportation to and from the ship, á la carte dining fees and beverages, shore excursions, transportation in port, telephone calls, souvenirs, additional gratuities, and taxes, are solely the winner's responsibility. The winner's guest will be required to sign a liability release before travel commences. All travel plans for the winner will be made through Carnival Cruise Lines. Reservations must be made in advance and are subject to availability, blackout dates, and all other terms and conditions as stated on the Carnival Cruise Lines Marketing Promotions Certificate which will be issued to winners. Once the cruise is confirmed, no changes will be accepted. Winner and guest must travel together and are responsible for obtaining all necessary travel documents and passports. Prize is nontransferable and non-refundable and must be accepted as awarded. No cash or other substitution may be made, except at the sole discretion of the Sponsor, who reserves the right to substitute a prize of equal or greater value. The odds of winning a First Prize will depend on the total number of eligible entries received. Total ARV of all First Prizes is $6,300.

 Grand Prize Finalist Drawings: PM or about the 15th day of each month during the Promotional Period, the Sweepstakes Administrator will select one (1) potential Grand Prize finalist in a random drawing from among all entries received during the preceding month. Each potential finalist will become eligible to participate in a special VIP event where one finalist will win the Grand Prize. The Sweepstakes Administrator will attempt to notify the potential finalists by USPS mail or by telephone within five (5) days of the drawing. If the potential finalist cannot be contacted within five (5) days after the first attempt to contact them, an alternate potential finalist will be selected in a random drawing from all remaining entries. After three (3) attempts to contact a finalist for any given month, the Sweepstakes Administrator reserves the right to declare no finalist for that given month. Decisions of the Sweepstakes Administrator are final.

Requirements of the Grand Prize Finalists: Except where prohibited, the potential finalists will be required to complete and return an Affidavit of Eligibility and Liability/Publicity Release (the "Affidavit-Release") within ten (10) days of being notified. If the potential winner fails to sign and return the Affidavit/Release within the required time period, an alternate winner may be selected in a random drawing from among all remaining entries.

The twelve (12) Monthly Finalists will be invited to attend a special VIP event, hosted by the Sponsor (date and venue TBD by Sponsor). At this event each finalist will be given a key fob(s) via a random-distribution process. The first finalist whose key fob will unlock the door of the Automobile on display will win the Automobile of their choice (up to $50,000 Manufacturer’s Suggested Retail Price) through the Automobile Dealership where their entry was selected from. Finalist must attend the special event/drawing in order to win, although a stand-in or proxy representative appointed by the finalist may attend in their place.

Grand Prize and Conditions: Grand Prize Winner will be required to execute and return an Affidavit of Eligibility, a Liability Release and (optional) Publicity Release, a copy of their current valid driver’s license and proof of insurability within 10 days of the date of the event. Winner is responsible for all taxes, tags/title/registration, insurance costs, surcharges, and delivery fees and all other costs incurred in claiming, registering or using the vehicle, as well as any costs above and beyond the stated $50,000 maximum value. (If winner selects an automobile of less than $50,000, the difference will not be awarded to them in cash or any other form of compensation). Odds of becoming a finalist depends upon the total number of eligible entries received. Odds of a finalist winning the Grand Prize are 1:12. Grand Prize is not transferable or redeemable for cash, except at Sponsor’s sole discretion. All taxes are the winner’s responsibility and a 1099 tax form will be sent to the winner in an equivalent amount of the Grand Prize value awarded. Prize acceptance constitutes permission (except where prohibited) to use winner’s name and likeness for publicity purposes without additional notice or compensation. ARV of Grand Prize is $50,000.

Maximum ARV of all prizes available to be won is $56,300.

General Conditions and Limitations: All entries become the property of the Sponsor. Sponsor may also substitute a prize of equal or greater value, due to unavailability or circumstances beyond Sponsor's reasonable control. Sponsor, Sweepstakes Entities and all related parties shall have no liability for entries that are incomplete or that may not be able to be accurately received due to online technical malfunctions or systems-related problems, beyond their reasonable control. Should technical problems impair or inhibit the fair conduct of this Sweepstakes, the Sponsor has the right to modify, cancel, or suspend the affected portion(s) of the Sweepstakes, and select winners from all eligible entries received up to the point of termination or suspension. Finalists and Prizewinners will be contacted initially by telephone, mail, or email, and confirmed in writing. In the written notice, Sponsor will provide all necessary documentation that the finalists and winners must execute before being entitled to redeem their prize. Finalists and Winners will be required to sign an Affidavit of Eligibility, a Liability Release, and, except where prohibited, a Publicity Release. Finalists and Winners must return the executed documents within ten (10) days of initial written notification, or an alternate winner may be selected. All federal, states, and local taxes on prize package offered, if applicable, are the sole responsibility of the winner. Limit one prize per person. Acceptance of the prize offered constitutes permission for the Sponsor and/or its agencies to use winner’s name and/or likeness for advertising and publicity purposes (were allowed by law), without further compensation. By entering, all entrants agree to release, discharge, hold harmless and indemnify the Sponsor, the Sweepstakes Entities and each of their respective subsidiaries, affiliates, directors, officers, employees and agents against any and all claims, liability, damages or causes of action (however named or described) due to any injuries, damages, losses to person or property of any kind with respect to or arising out of, in whole or in part, directly or indirectly, entrants’ participation in this Sweepstakes, participation in any Sweepstakes-related activity, and/or the receipt, possession, acceptance, use or misuse of any prize awarded herein. All prizes are awarded “as is” with no at-law or implied warranties whatsoever. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Independent Sweepstakes Administrator.

Independent Sweepstakes Administrator: This sweepstakes is being administered by The US Sweepstakes & Fulfillment Co., 625 Panorama Trail (Building 2, Suite #100 ), Rochester, NY 14625 , whose decisions will be considered final in all matters related to the conduct of this promotion.
